OCEANIC GATEWAYS TOURISM AND TRAVEL SDN BHD

By purchasing any independent travel package offered by Oceanic Gateways Sdn Bhd (OG), you (hereinafter referred to as the “customer/passenger”) automatically agree to be bound by the Terms and Conditions of OG as outlined below. Customers are required to read and fully understand these Terms and Conditions to ensure the validity of the booking and to confirm that you have the authority to accept these Terms and Conditions on behalf of yourself and all passengers confirmed under your booking.

OCEANIC GATEWAYS TRAVEL AND TOURISM

Oceanic Gateways (OG) acts as a booking agent for travel services provided by third parties, including but not limited to airlines, accommodation providers, transportation companies, and tour operators. OG is not the direct seller of these products, and customers enter a direct contractual relationship with the respective suppliers.

TRAVELSERVICES
We offer a wide range of travel-related products from various suppliers and third parties (“Suppliers”). Each Supplier has its own terms and conditions which will apply depending on your travel arrangements. In addition to our general Terms and Conditions, customers are strongly advised to review and understand the terms and conditions of each involved Supplier.

All bookings and travel arrangements may be made through our website. This website is owned and licensed by us and is referred to in this agreement, accessible at oceanicgatewaystravel.com.

 DEPOSIT & PAYMENT

A deposit payment is required to secure a booking; however, prices are not guaranteed at this stage. Prices will only be confirmed upon receipt of full payment and the issuance of travel documents, subject to the terms and conditions of the relevant Suppliers. The full payment due date will be communicated to the customer.

By providing payment details, the customer authorizes us to process payments to the relevant Suppliers on their behalf. Personal cheques are not accepted as a method of payment.

After full payment has been made, prices may be subject to change due to supplier terms or variations in costs such as fuel surcharges, taxes, fees, and currency exchange rates. Any price changes will be communicated to the customer accordingly.

CANCELLATION, CANCELLATION FEES & REFUNDS

If a customer cancels a booking, a partial refund may be considered, subject to the cancellation terms and conditions imposed by the respective suppliers and the service fees of Oceanic Gateways Travel as stated in the receipt or booking confirmation.

Customers are required to present the original booking confirmation and proof of payment before any refund can be processed. Any deposit paid is non-refundable if the cancellation is made before the final balance payment due date.

Refunds will only be processed after Oceanic Gateways Travel has received the refunded amount from the relevant supplier and partially used air tickets are generally non-refundable.

Oceanic Gateways Travel shall not be held responsible if the supplier fails to issue a refund. However, customers may claim cancellation charges through their travel insurance provider if the cancellation is covered under their respective travel insurance policy.

DEPOSIT AND FULL PAYMENT

Customers are responsible for ensuring that the deposit is paid upon booking confirmation and that all subsequent payments are made in accordance with the prescribed payment schedule. The deposit and full payment are non-refundable, unless the cancellation is made in accordance with the specified cancellation schedule and time.

CUSTOMER RESPONSIBILITIES

  1. Passport

Customers are responsible for ensuring that their international passport is valid for at least six (6) months from the date of departure and that they possess all required travel documents. A copy of the passport information page must be emailed or faxed to OG Customer Service or the appointed sales representative for verification of ticket bookings and travel documents.

Customers must also ensure that they are not blacklisted or restricted by any authorities such as PTPTN, banks, the Insolvency Department, the Inland Revenue Board (LHDN), or any other relevant agencies that may prevent travel. Oceanic Gateways (OG) shall not be held responsible for any refunds, changes, or postponements of travel should such situations arise.

  1. Insurans Perjalanan

OG strongly advises and encourages all customers to obtain travel insurance coverage for the duration of their trip, in line with recommendations by the Malaysian Association of Tour and Travel Agents (MATTA).

Customers who have purchased or are required to purchase travel insurance must sign the relevant claim or indemnity forms for compensation purposes in the event of any unforeseen incidents during the trip. Customers who fail to sign and return the required forms will not be permitted to participate in the tour, and in such cases, OG shall not be responsible for any refunds, rescheduling, or compensation should any unexpected issues occur during the journey.

RIGHTS AND RESPONSIBILITIES OF OCEANIC GATEWAYS SDN BHD

OG and/or its appointed agents act solely as intermediaries for transportation companies, hotels, and other service providers. All tickets, vouchers, and travel documents are issued subject to the terms and conditions of the respective service providers.

OG and related parties shall not be held liable for the following:

  1. Any errors, misunderstandings, or changes to the travel arrangements or scheduled itineraries.
  2. Any additional costs arising from delays or changes in transportation services, medical issues, adverse weather conditions, strikes, wars, quarantines, or any other circumstances beyond OG’s control.
  • Any damage to or loss of baggage or personal belongings, as well as accidents; customers are responsible for submitting insurance claims to the relevant insurers.
  1. Denial of entry or deportation by immigration authorities due to possession of prohibited items, invalid travel documents, or issues related to local policies or actions taken by foreign governments

Any difficulty, lack of cooperation, or unreasonable behavior by customers that disrupts the smooth operation, goodwill, or safety of the trip will be addressed by OG Management.

During the trip, OG representatives may capture or use photographs and videos of customers, either individually or in groups, for marketing and promotional purposes, subject to the following uses:
